Section 1 This website is operated by the non-profit organization (VZW) Wildhood, with its registered offices in BE-9100 Sint-Niklaas, Gladiolenstraat, 34. Wildhood offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. Please read these Terms and Conditions carefully before accessing or using our website. By visiting our site and/or purchasing Products or Services something from us in our webshop, you agree to be bound by the following terms and conditions, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Section 2 We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
Section 3 Prices for our products and services are subject to change without notice. We reserve the right at any time to modify or discontinue the Products or Services (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Products or Services.
Section 4 The Agreement comes into force at the moment that the Adventurer confirms his purchase on the webshop by clicking the button “purchase”.
Section 5 When purchasing products and services on this website the Adventurer can cancel the Agreement, without stating the reasons for dissolution, within 14 days. This period starts, with regards to Products, on the day after receipt of the product by or on behalf of the Adventurer, or, with regards to Services, on the day of entering into the Agreement. During this period the Adventurer shall handle the products and the packaging cautiously. They will only unpack the product as much as is needed to be able to assess if they wishe to keep the product. If they wishe to make use of the right of withdrawal they will return all supplied accessories and – if reasonably possible - in 2 the original state and packaging, to Wildhood, in accordance with the reasonable and clear instructions provided by the Wildhood. If the Adventurer makes use of their right of withdrawal, the Adventurer will bear all expenses of the return shipment. If the Adventurer has paid an amount the Adventurer will refund this as soon as possible, and at the latest within 30 days after return or withdrawal.
Section 6 Wildhood shall take the greatest possible care when receiving and executing the orders of the products. The delivery location is the address that the Adventurer has provided to Wildhood. Wildhood can never be held liable for any delay in the delivery of goods and services. If the delivery of an ordered product appears to be impossible the Wildhood will endeavor to provide a replacement item. At the latest upon delivery it will be clearly and comprehensibly indicated that a replacing article is being delivered. For replacement articles there can be no right of withdrawal. The cost of return shipment is borne by Wildhood. The risk of damage and/or loss of products lie with the Adventurer as of the date of purchase, unless explicitly agreed to otherwise.
Section 7 The Products and Services purchased through this website must be paid at the moment of purchase. In the event of default by the Adventurer, Wildhood has the right to charge the Adventurer interests for late payment at an interest rate of 8 % and an indemnity of 10%, without the need of any preceding summons. Wildhood will also have the right to suspend or terminate the Sale of Products or the Services entirely or in part if payment is not received within thirty (30) days of the purchase date.
Section 8 The Adventurer acknowledges that all intellectual property rights of provided information, announcements or other expressions with regard to the products and/or with regard to the internet site are owned by Wildhood, its suppliers or other rightful beneficiaries.
Section 9 Wildhood will only process the details of the Adventurer according to its privacy policy. Wildhood will observe the applicable privacy regulations and legislation.
Section 10 Adventurers should be aware that cycling both on and off-road is an inherently risky activity. Furthermore, the tours, campouts and bikepacking trips are self-supported. Adventurers thus participate at their own risk. Adventurers declare to be physically well prepared and in good health condition to take part in any bike ride, campout, bikepacking trip or any other event organized by Wildhood, with the full understanding that most rides will, for a large part, take place 2 off-road, on gravel and/or other unpaved roads, and may even take part during evening or nighttime. They also need to have a bicycle in well maintained condition and can be refused participation if that is not the case, at the sole discretion of Wildhood. By participating at any event, the Adventurers commit themselves to renounce to any claim it or any of its beneficiaries, any heir or close family (parents, spouse or husband, kids) and their insurance provider against the organizers of the event (Wildhood vzw), other participants and the insurance providers of the persons mentioned in the previous points for any harm that they would sustain before, during or after the event. In case of death, this commitment is alss valid for the beneficiaries, the heirs, the close family and our insurance providers. The adventurer commits not to ride under the influence of alcohol, drugs or stimulants and will be refused participation if that were the case. The sentences, penalties or any cost of any nature, incurred following road traffic offenses or any other legal offense, will be exclusively at charge of the Adventurer. The GPX track received from the organizers is directional, if by any case roads happen to be blocked from riding, it is the riders own responsibility to take the appropriate detour or dismount. The Adventurer releases the organizers and the VZW Wildhood of any liability in case of accidents. A disclaimer may still need to be signed before taking part of any activity.
Section 11 Wildhood will not be liable or pay you any compensation if our contractual obligations to you are affected by any event which we or the supplier(s) of the Services in question could not, even with all due care, foresee or avoid, such as war, strikes, pandemic, natural or nuclear disaster, fire, etc…
Section 12 You can review the most current version of the Terms and Conditions at any time at this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms and Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes.
Section 13 These Terms and Conditions and any separate agreements whereby we provide you Products or Services shall be governed by and construed in accordance with Belgian law. Any dispute will be exclusively submitted to the courts of Brussels.
